Legal Requests & Enforcement

Suspensions, appeals, law-enforcement requests and disputes.

1. Suspension and termination process

We may restrict, suspend or close an account for unpaid fees, breach of the Terms or Acceptable Use Policy, a legal requirement, or a serious security or fraud risk. Unless urgent action is needed or the law prevents it, we will:

  1. notify the account holder by email or in the dashboard, stating the reason and the policy concerned;
  2. give a reasonable opportunity to respond or fix the problem (normally at least 7 days for non-urgent matters);
  3. apply the least restrictive measure that addresses the problem;
  4. confirm the outcome in writing.

2. Appeals

If you believe a decision was wrong, email kendagortech@gmail.com within 14 days with the subject "Appeal" and any supporting information. Someone who was not involved in the original decision will review it and reply within 14 days. If an appeal succeeds we will restore access and, where the error cost you subscription time, credit that time.

3. Requests from law enforcement and authorities

We respect our users' privacy and the law. We disclose personal data to a government authority only when we receive a valid legal request, such as a court order, warrant or a lawful notice issued under Kenyan law, and only the data that the request requires. We:

  • check that each request is valid and properly issued, and push back on requests that are overly broad or unlawful;
  • notify the affected account holder before disclosure unless the law or the order prohibits it, or notice would create a risk of harm;
  • keep a record of every request and our response.

In an emergency involving a risk of death or serious physical harm we may disclose limited information without a court order, to the extent the law permits.

4. Preservation of evidence

Where we suspect fraud or other serious misuse, or receive a lawful preservation request, we may preserve relevant data for the time reasonably needed for investigation or legal proceedings, even if it would otherwise be deleted.

6. Intellectual-property and content complaints

If you believe content hosted through the Service, such as a captive portal page, infringes your rights or is unlawful, email kendagortech@gmail.com with the URL, a description of the problem and your contact details. We will review it, may ask the ISP concerned to respond, and will remove or disable content that is unlawful.
